Council President Glen Stewart called the meeting to order at 7:00 p.m.

Ord. 80-06
Item (a) AN ORDINANCE APPROVING THE RECOMMENDATIONS OF THE ENTERPRISE ZONE NEGOTIATION COMMITTEE WITH REGARD TO AN ENTERPRISE ZONE TAX INCENTIVES APPLICATION FOR NOVATEX NORTH AMERICA, INC. AND SIMONSON HOLDINGS, LTD.

Moved by Wertz and seconded by Valentine W2 to invoke Section 113.01 of the Codified Ordinances as the distribution of this Ordinance has satisfied the requirements of said Section and that a further reading be dispensed with at this time.

Comments:
    Valentine W1 told Council that he attended a Conference presented by the Ohio Municipal League, and having the chance to talk to a couple of City Managers and others, he realizes how important this kind of thing is.  He emphasized he feels more comfortable with it now.
    
Moved by Detrow and seconded by Valentine W1 that the Ordinance be passed on the first reading.

Moved by Wertz and seconded by Detrow that the rules requiring the reading on three separate days be suspended and that the Ordinance be passed on the second and third readings.

Ord. 81-06
Item (b) AN ORDINANCE AUTHORIZING CERTAIN LAND BELONGING TO THE CITY OF ASHLAND, OHIO, TO BE LEASED, AND SUBSEQUENTLY SOLD, THROUGH THE COMMUNITY IMPROVEMENT CORPORATION; AND DECLARING AN EMERGENCY.

Moved by Wertz and seconded by Valentine W1 to invoke Section 113.01 of the Codified Ordinances as the distribution of this Ordinance has satisfied the requirements of said Section and that a further reading be dispensed with at this time.

Item (c) FISCAL OFFICER’S CERTIFICATE: $2,400,000 NOTES

Finance Director Anna Tomasek certified in connection with the proposed issue of $2,400,000 notes to be issued in anticipation of issuance of bonds for the improvement of the municipal water system by acquiring real property and interests therein for municipal water system purposes.

Moved by Valentine W1 and seconded by Valentine W2 to approve the Fiscal Officer’s Certificate.

Item (d) AN ORDINANCE PROVIDING FOR THE ISSUANCE AND SALE OF $2,400,000 NOTES, IN ANTICIPATION OF THE ISSUANCE OF BONDS, FOR THE PURPOSE OF IMPROVING THE MUNICIPAL WATER SYSTEM BY ACQUIRING REAL PROPERTY AND INTERESTS THEREIN FOR MUNICIPAL WATER SYSTEM PURPOSES; AND DECLARING AN EMERGENCY.

Moved by Wertz and seconded by Valentine W1 to invoke Section 113.01 of the Codified Ordinances as the distribution of this Ordinance has satisfied the requirements of said Section and that a further reading be dispensed with at this time.

Comments:
Tomasek explained that this ordinance is to issue the sale of $2,400,000 notes, and the purpose is basically the purchase of the Riley property for the reservoir. A 5.25% interest rate is expected.  Mayor Strine and Law Director Rick Wolfe stated that this is a renewal.

NEW BUSINESS

(a) Discussion of a possible extension of time regarding the demolition of the A. N. Myers Home located on Center Street and owned by the Ashland County Historical Society

Comments:  
    Stewart asked if there was anyone here representing the Historical Society, and there was not.
    Stewart explained that the only way the City of Ashland can enter into an agreement to extend the permit is if the applicant applies and asks to do that.  Council could concur with them or could deny that.  They have to be here.  This item is on the agenda at the request of the Ashland Historical Society.  He has a note that the board met at noon and took no action; being no action does not mean they voted one way or the other.  But they are not going to present their request at this meeting to have an extension granted or denied, however the case might have turned out, to extend this permit.  Had it been extended, the time agreed to extend would be similar to the first permit; there would be no action on the property until that permit time had expired.  
    Council is in no position to take any action whatsoever without the applicant being here.  Stewart emphasized that he learned this about 2:00 p.m. and there was no way to put a notice in the paper for those who came to be a part of this.  He apologized for this and also because this is an action not within their control at this table.
