ACT, OF THE CITY OF ASHLAND, OHIO; AND DECLARING AN EMERGENCY.

Questions or Comments?
On page 7, the last paragraph. Is that a change from what
we had in the past? Or is this pretty much what we have had?
Cherie Helterbridle: We did not change that this year. I
think it may have been changed maybe three years back, but that has not
changed this year. The red line copy that I have you can see it
has not changed. The only thing that was changed on that was the
numbers in 2007 and 2008. The wording has not been changed.
Paul Wertz: Do you know what the wording was in 2004?
Cherie Helterbridle: I can’t speak to 2004. I know
that previous to this change, it would read in such a way that everyone
would automatically receive a pay increase and the change when it
happened made it so that there was a process for receiving a pay
increase. It wasn’t automatic.
Robert L. Valentine W1: This last sentence says, also with the
approval with the majority of City Council, employees may be granted a
temporary wage increase while performing duties of the position
temporarily vacated due to extended sick leave, retirement, or other
extended leave of absences.
Cherie Helterbridle: That has not been changed at all, ever.
Robert L. Valentine W1: What does that mean? It gives
Council the power to otherwise if it is within the realm of whatever;
let’s say it starts with $40,000.00 to $60,000.00, if it is
within that realm than the elected officials have the power to change
the wage, correct? Let’s say it is 40,000.00 to 60,000.00
right:? And let’s say the person who is receiving 56,000.00 or
57,000.00; could either one of the four elected officials raise that up
to the top?
Cherie Helterbridle: Yes, that is my understanding.
Robert L. Valentine W1: Okay. I am just trying to clarify
that.
Mayor Strine: To clarify a little further, as long as the money
is appropriated. This does not appropriate the money.
Paul Wertz: Just so they appropriate the 3%, right.
Mayor Strine: No. This only authorizes it, it does not
appropriate it until you pass the appropriation with the money included
for the raises, then they could. But not until you approve the
appropriations. For instance, if you had an issue with somebody
going from 40,000.00 to 60,000.00, you could change how much was
appropriated so that there wasn’t enough money appropriated to go
from 40,000.00 to 60,000.00. We are talking two different issues
here. The authority to amend the appropriations and money, the
funds to do it.
Robert L. Valentine W1: When we appropriate the money though,
when you say appropriate, is that the total thing when you are talking
about appropriations?
Mayor Strine: No, you could go by line item. Every line
item you could look over if you wanted to and that would be where
Council’s authority would come in. If you don’t want
to appropriate the money. Then don’t.
Paul Wertz: The trouble with going through every line item, it
would take all year for us to go through that line item.
Mayor Strine: I am just telling you, that is the way it is.
You have the authority to change these things. I am just telling
you, that is the way it is now.
Robert L. Valentine W1: So this is the way that Cherie had
mentioned before. I understand what you are saying. Now the
last part of it then, when you make a temporary vacancy, and someone
takes over, Council has to approve that?
Mayor Strine: To be honest with you Bob, I was not aware of this.
Ruth Detrow: I have one more question. Same
paragraph. It says that “an increase may be granted with
approval of the Mayor or Director of Finance or Director of Law or
Judge of the Ashland Municipal Court, So that means that the Mayor
could approve all of the increases or the Director of Finance could?
Cherie Helterbridle: That means, those elected officials have
certain employees under them. I believe the elected officials are
responsible for approving those for their own employees that answer to
them, that are under them so the judge of the municipal court has proof
of employees that he would be responsible, Finance Director has a group
of employees that the Finance Director would be responsible for.
Ruth Detrow: Well I thought that is what it meant, but is that
what it says?
Glen Stewart: Well with the or’s and the approval of the
Mayor. I see where the confusion is. It is not totally
specific that with the approval of the Mayor for his administrative
staff or the Director of Finance.
Ruth Detrow: Is there any kind of check on that anywhere?
Cherie Helterbridle: I think because there is a comma there but
when it is one, or the other then that becomes another entity in my
understanding.
Ruth Detrow: That still doesn’t change what is said
there. I am being picky I imagine, but I want it to say what we
know it intends to say.
Cherie Helterbridle: With all due respect I think that it
does. I think that it does because of the punctuation.
Glen Stewart: If there is a desire on the Council to have this
rewritten and have the Law Director rewrite this paragraph for based on
your understanding, no one is going to fuss with that. I want it
to be clear. I am in a poor position as far as punctuation.
So I don’t if it is right or wrong but it needs to be clear for
everyone.
Ruth Detrow: And what is correct legally is quite often different
from what my 30 years as an English Teacher and two degrees would say.
Glen Stewart: So if there is a desire for this Council to have
this changed to a clearer understanding, so be it.
Robert L. Valentine W1: Can I ask one more question?
In section 2 of the first paragraph. Cherie you answered that,
“this is the way it had been before” and I understand
that. When we had these in the past, didn’t we always use
the word, may?
Cherie Helterbridle: There was a change a few years back, and
when the change happened, we went to “may” and that has
been like that for at least 3 years now. Prior to that it said
“shall”. I think that maybe the change occurred about
2001 and we went from shall to may. So it has been a number of
years.
Paul Wertz: Do I understand this right Mayor? If we pass
this contract, everybody gets a 3% raise? How about merit raises?
Because it Is built in. Am I understanding this right, it is built in
for 6%, so it is 3% right now? So that means if we pass this
Ordinance; let’s say somebody decided to give a couple of other
employees a raise. That means somebody has to come to you and you have
to okay it right? If the money is there.
Mayor Strine: That is if the appropriation has been made.
Paul Wertz: So if we pass this at 3% and we go through the
appropriations and we don’t put enough in there for merit raises,
so be it right?
Mayor Strine: Right. Then they cannot get raise.
Paul Wertz: If people deserve a raise, they should have the
raise. But I hate to see a whole bunch of people at one time
getting a raise.
Robert L. Valentine W1: Will you explain that; I am trying to
follow what you said?
Paul Wertz: If we pass the Ordinance; it is 3%. Okay, what
happens down the line, the top end is 3% above that 3% that we have, so
that is for a merit raise. So if every department decided that
they want to give a merit raise, no money has to be there. If we
pass the appropriations, the budget and it is not there, you cannot get
the merit raises. Financially, what is that going to do for
the city the way that is set up?
Mayor Strine: Paul I do not know how to answer this
dilemma. I think back to the example with Bob and the 40,000.00
– 60,000.00 dollar range that is in there. If you only
appropriate 40,000.00 dollars to that line item when you do the
appropriation, that is all that individual is going to get.
There is no latitude for anybody to do anything because there has only
been 40,000.00 appropriated. This does not appropriate any of the
money. And back to your issue, whether you give somebody a merit
increase or not. I guess if you are going to limit the Mayor on
giving merit increases then somehow, I guess Council will need to get
involved on reviewing people.
Paul Wertz: Council is not on the daily operations of these departments
and you are in charge of the departments, so you would know.
Glen Stewart: I think that it is important that Council and our Mayor
work very closely together and I think that the position of Mayor
should come with a level of trust and integrity that if a Division
Director petitions the Mayor for an increase over and above what they
may receive and this doesn’t say they will receive 3%. It
says, they may receive an increase of 3% and I think as we talked 2
weeks ago, that is up to and that is a maximum wage increase across the
board, that is how I understand it. If the department head should
petition the Mayor or one of the judges, whoever would petition him for
an increase for one of their people above the 3%, the salary ranges are
currently set, that they could receive an addition 3% of the department
head saw fit to petition the authority and they approved it. If
the individual line items were reduced to 3% instead of the
range. If the range was reduced to 3% above the current then they
could only get 3%. With the 6% in the range, the authority to go
to issue that other 3% if someone chose to; it has to be appropriated
in the budget. So there is two from my perspective, there are two
areas that could work simultaneously or they could work against each
other, however you see fit. By passing this as it stands
today, it is my understanding there is 6% in that range rounded off to
the nearest 0. When we look at the budget, where the
appropriation request, I presume that it reflects the same, but I
don’t know that; I haven’t looked at that.
Robert L. Valentine W1: That only pays 6% in the Ordinance that
we are talking about.
Glen Stewart: I think all four Ordinances are similar.
Robert L. Valentine W1: So that would mean that all four; the
Judge, the Finance Director, the Mayor and the Law Director, they all
have that, it is in there?
Glen Stewart: It is my understanding it is all in there.
Mayor Strine: I believe it is correct to say that it has always been
that way. It is not something new. Isn’t that right
Cherie? Am I correct in saying that? There has always been
in this Ordinance a range.
Paul Wertz: It is just tough passing these without the budget
being in place.
Glen Stewart: Well until the budget is in place, there is
nothing. There is no money to appropriate.
Paul Wertz: Well, you will still continue to get the 3%.
The raise goes into affect 30 days after you sign it. So you will
get the 3% for sure. Is the effective date on there?
Robert M. Valentine W2: Effective January 1,
2008.
Paul Wertz: That the pay raise would start even though you have
not made the appropriation yet.
Glen Stewart: Only the 3%, or could merit raises be given also.
Mayor Strine: No I don’t think merit raises could be given
until you do pass the appropriation. I guess that is dependent on
what finance does with them. I haven’t seen that
happen.
Glen Stewart: Anna, if we pass this Ordinance, is Finance in the
position to honor this Ordinance and give everyone a 3% increase?
Anna Tomasek: We would have to do a retro pay, but yes.
Glen Stewart: It is not dependent on passing the appropriation
request.
Anna Tomasek: No, everyone would get the
3%. Unless the division director or elected official would choose
up to 3%. If Council passes this legislation tonight for the
Ordinances, Finance would have enough time that there would not be
retro pay for the first one.
Glen Stewart: So their first pay in January would include this
increase?
Anna Tomasek: Correct.
Glen Stewart: Did you all hear that? Finance is in the
position that if we pass these Ordinances today, they would go ahead
and implement the 3% increase and it would not be retro, they would
have time to process this and get it in to the first pay in
January. Cherie, there have been no increases in all others?
Cherie Helterbridle: That is correct.
Glen Stewart: So back to the Ordinances that are on the table, is
there a direction from Council?
Mayor Strine: I would like to recommend to Council that they do
pass this and address their issues in the appropriation
Ordinance. I really honestly don’t think you are doing
anything out of the ordinary with this Ordinance and it does allow
Finance to figure the raises, but people are expecting at the beginning
of the year.
Paul Wertz: Any idea when the budget would be ready for us to take a
look at?
Anna Tomasek: I do not know that.
Robert L. Valentine W1: Is what you are saying Bill is that you
are recommending that we move ahead and that we take this up when we
talk about the appropriations, is that right? That would be
when? In April?
Mayor Strine: We have been working on the appropriation for the
last month approximately that we are going to recommend to Council and
in fact, it will be the next Mayor who will recommend to Council and
right now we are waiting on the actual year end figures, once finance
closes the books at the end of the year then we will have the actual
figures that we have to work with and so I would guess within near the
end of the month that they will be able to bring an appropriation
recommendation to you in that many of you will take time to study that
and you could look at all of the salaries. Honestly it is all
there in the information.

Item (e) AN ORDINANCE CREATING ADDITIONAL
APPROPRIATIONS, TRANSFERS, AND AD-
VANCES FOR THE FOLLOWING HEREINAFTER NAMED FUNDS FOR THE YEAR 2007 AND
DECLARING THIS LEGISLATION TO BE AN EMERGENCY MEASURE NECESSARY TO
MEET THE FINANCIAL NEEDS OF THE CITY OF ASHLAND, OHIO.
Glen Stewart: This Ordinance will have to be read. The
content is results of year-end work in the Finance Department and this
is a very normal process and I am going to ask Anna to take us through
this.
Anna Tomasek: I am going to read the entire Ordinance
starting with section 1.

Glen Stewart: Thank you Anna.
Robert L. Valentine W1: I would like to ask you a question.
When you use the term personal (nal), what is that?
Anna Tomasek: That is salaries, fringes and benefits. Other
would be like materials and supplies.
Robert L. Valentine W1: Wouldn’t that be el or (al)?
Anna Tomasek: It would be (al) Personnel like
personnel people would be el.
Mayor Strine: When you pass the appropriation Ordinance, all of
the line items of the divisions might have 25 line items which includes
salaries and other benefits. That is what they mean by personal
services. Then all of the other accounts are the Other
accounts. So you only appropriate two figures. One total up here
and one total down here.
Anna Tomasek: You appropriate basically salaries and all other in
two categories.

Ruth Detrow: Line 801, Income Tax; it is a little over
1,000,000.00 dollars (1 million dollars). Is that above the
amount?
Anna Tomasek: Yes we estimated our revenue estimate for income
tax collections for the year 2007 and the actual collections of income
tax was 8,554,563.90 dollars as of today.
Robert L. Valentine W1: How does that compare to last year?
Anna Tomasek: It is relatively the same numbers.
Glen Stewart: Anna just for the record, all of this finalizes
everything that is required for adjustments for 2007?
Anna Tomasek: Yes that is correct.

ENTER INTO AN AGREEMENT WITH THE
ASHLAND COUNTY SOLID WASTE DISTRICT; AND DECLARING AN EMERGENCY.

Glen Stewart: Basically the Solid Waste District is changing
their methods of going from a generation fee to a contract fee and that
is all language that allows them a little more, considerably more
authority over the dump. If “Joe Smith” picks up a
load of trash in Ashland Ohio and takes it to some dumpsite that is not
near you. Ashland Solid Waste District will still get their 7.50
dollars a ton from that district and they have the authority to request
that information from the dumpsite or the landfill. They feel it
gives them better control. All of this is tied together with a
1.00-dollar increase per ton to the City of Ashland and the assurance
and the letter that is a part of the contract as our attorney, Richard
P. Wolfe II, this letter of agreement includes the fact that that 7.50
dollars per ton fee will not be increased to the City of Ashland
without the Mayor and the Council’s consent. I specifically
asked our Law Director to look at this and he has and he said that the
letter becomes a part of the contract and the Resolution, and so we are
covered.

Motion to move to Executive session by Glen Stewart to discuss matters
pertaining to the appointment to fill a vacancy of an elected official,
moved by Paul Wertz, seconded by Robert M. Valentine W2.

Glen Stewart: No action will be taken in this meeting, it is to
discuss matters pertaining to the appointment and I have covered this
with our Law Director and he tells me it is well within the limitations
of the Sunshine Law so we will move to Executive Session and upon our
completion we will come out and if it is appropriate we will take
action before we adjourn.

Move to reconvene back into Special Session by Paul Wertz, seconded by
Ruth Detrow.

Reconvened back into Special Session at 1:14 pm.
Glen Stewart: I want to report to you that next Wednesday evening
at our Special Meeting, it starts at 7:00 pm in the Council Chambers
Conference room. This Council will be prepared to announce
the appointment to fill the vacancy for Mayor. That will
happen next Wednesday after the pledge. Also President of Council will
be voted on and announced.
