Motion to Excuse Robert M. Valentine W2 and moved by Robert L. Valentine W1, seconded by Paul Wertz.

LEGISLATION

Ord.  No.  24-08
Item   (a)  AN ORDINANCE APPROVING, RATIFYING AND CONFIRMING THE AN-
                NEXATION AGREEMENT, WITH MONTGOMERY TOWNSHIP, AND DECLAR-
                ING AN EMERGENCY.

Moved for non-reading in full by Ruth Detrow and seconded by Robert L. Valentine W1 to invoke Section 113.01 of the Codified Ordinances as the distribution of this Ordinance has satisfied the requirements of said Section and that a further reading be dispensed with at this time.

Mayor Stewart:  I would consider this a housekeeping Ordinance.  The agreement was entered into in 2004 with Montgomery Township to allow for an expedited annexation process out at the East Corridor.  Within the agreement, the city has agreed to reimburse or redistribute certain tax dollars back to Montgomery Township for a specified period of time.  Those tax dollars need to be sent back to Montgomery Township and during that process, it was found that we needed to have an Ordinance or Resolution that adopted the agreement that was made.    There is absolutely no change to the agreement that was made in 2004.  Everything is status quo.  This is again a housekeeping situation that needs to be in order to ratify or confirm that particular agreement and thus allow us to reimburse Montgomery Township the tax dollars that were committed as a part of the agreement.

Motion to pass on the first reading by Ruth Detrow, seconded by Stephen Stuart to invoke Section 113.01 of the Codified Ordinances as the distribution of this Ordinance has satisfied the requirements of said Section and that a further reading be dispensed with at this time.

Move to suspend the rules 3 separate meetings, 3 separate nights by Paul Wertz, seconded by Robert L. Valentine W1, to invoke Section 113.01 of the Codified Ordinances as the distribution of this Ordinance has satisfied the requirements of said Section and that a further reading be dispensed with at this time.
   Ayes: Stephen Stuart, Robert L.  Valentine W1, Ruth Detrow, Paul Wertz.

Move that the Ordinance be passed by Ruth Detrow, seconded by Robert L. Valentine W1
