Council President Paul Wertz called the meeting to order at 4:00 P.M.

    Item  (a)  AN ORDINANCE AMENDING SECTION 2 OF ORDINANCE NO. 5-75, AS AMENDED
                            BY ORDINANCE NO. 69-08, RELATIVE TO THE CAPITAL IMPROVEMENT FUND; AND
                            DECLARING AN EMERGENCY.

Move for non-reading in full by Robert M. Valentine W21, seconded by Stephen Stuart, to invoke Section 113.01 of the Codified Ordinances as the distribution of this Ordinance has satisfied the requirements of said Section and that a further reading be dispensed with at this time.

Mayor Stewart:  The reason behind this is that, as we work through the 2009 Budget process; it is extremely tight and extremely tight is pretty generous.  We had anticipated early on that this fund would generate about $260,000.00 dollars of interest.  And that we had anticipated splitting that between the 405 fund and the general fund.  I think at this point in time, I am confident that our Finance Director agrees with me, that may be very optimistic today.  So, because of the need for the operations of the city, we are recommending that all of the funds that are generated by the investments of the accounts go toward the general fund for the next two years and not be split between the general fund and the capital fund.

    Item  (b) AN ORDINANCE AMENDING SECTION 221.05 OF THE CODIFIED ORDINANCES OF THE
                  CITY OF ASHLAND, OHIO, RELATIVE TO THE ALLOCATION OF MUNICIPAL INCOME TAX
                  FUNDS; AND DECLARING AN EMERGENCY.

Move for non-reading in full by Robert M. Valentine W21, seconded by Robert L. Valentine W1, to invoke Section 113.01 of the Codified Ordinances as the distribution of this Ordinance has satisfied the requirements of said Section and that a further reading be dispensed with at this time.

Mayor Stewart:  Again, this reallocation of the City Income tax is being recommended to this Council for the following reasons, similar to what I just said.  The general fund is very, very strapped and to put more of the income tax receipts into the general fund for the operations of the city, we are recommending that the street fund be reduced to a maximum of $200,000.00 dollars or 2.72%, not to exceed $200,000.00 dollars and that the Park fund receives 7.87 to a maximum amount not to exceed $580,326.00 dollars.  Any amount collected over the calculated amounts will go directly to fund 101 general fund for Municipal operations.

Mayor Stewart:  No.  I didn’t put two years in this one Bob.  It is permanent until it is changed back.
