Eric Akers:  This is a continuation of the existing maintenance agreement we have had with CMI.  They are our primary software providers.  They have for a number of years provided the hardware service maintaining the new equipment as well.   I would report to the Council that this year we have upgraded our main system into acquiring state of the art servers as well as software and other equipment both in the Court for audio and video recording as well as the primary data management system that we have.  It is my hope of within the next year or so that we can avoid the necessity of continuing this agreement and rely upon the City’s IT department for primary service.  There are two other projects that I need to have done before I do that though.  One is to convert the existing Civil area of the court into a Windows-based data system which CMI will also service and then also take the entire court into an internet web base service which we are required to do by the Supreme Court over the next few years.  If we are able to do that within the next few months, we will probably need one of the smaller courts to be able to do that.  Hopefully by spring or early summer.  Once we do that then I believe we can hopefully rely upon our primary IT department within the city and avoid the necessity for this.  The previous contract that was entered into with CMI was around $24,000, thus negating the necessity of having Council’s approval, but with inflation I think primarily that is what this is. A contract for over $25,000.  It is for a one year period and after that as I said, hopefully we can use the city’s IT department.  If you have questions, I would be glad to answer them.

Robert L. Valentine W1:  That is your computer fund and it is $26,000?

Eric Akers:  We have, I think now, around $300,000.  We have one other expenditure which was for the replacement of the meeting frames of  $62,000.  We have had some other expenses that we have been able to divert into that computer fund to alleviate the burden on the general fund which we have been able to do and then one of the discussions that the Mayor and the court have had, I believe we not only will have enough to take care of this but also to address the other needs that we are going to be needing not only for this year and next year but for years to come.

Comments:

Mayor Stewart: This is the Easement that allows the Railroad to cross; to enter into the actual Business Park after they cross Faultless Drive.  It is the Easement that will allow the citing to be built to serve Barbasol.  This has been in the plans; it is a requirement that we agree with to provide that land for that citing and the rail spur.  That rail citing will service Barbasol but it will also have a turn out built into it that will allow it to go further back into the Business Park as various other entities are developed and require rail service.  If there are any questions, I will attempt to answer them.

PUBLIC HEARING #1  - Alley Vacation 12 foot wide Davis and Fairbanks

Paul Wertz:  This is a Public Hearing, before the Board of Revision of Assessments regarding a certain 12-foot wide alley as set forth in Resolution 12-09.

Rick Ewing- Ashland University: I have been here before Council before in this basically we are requesting the vacation of an alley and this particular 12-foot alley is the one located between Davis and Fairbanks.  This is a back yard alley that borders much of our property as well as two others.  The purpose for vacating is putting in a parking lot and since it is bounded on both sides by our property we would like to make two requests to Council.  

Richard P. Wolfe II, Law Director:  It is my understanding that there are no utilities in this alley, is that right?

Rick Ewing:  Right.

Richard P. Wolfe II:  There is no anticipation for any need for any?

Rick Ewing:  No

Paul Wertz:  Anyone else want to be heard on this?

Ruth Detrow:  This is our meeting of the Revision of Assessments?

Richard P. Wolfe II :  Technically it is the hearing before Mr. Strine, the Mayor and I; we are kind of compressing all of this so as soon as we are done with this hearing then we will make a motion regarding that and then we can move onto other business and come back to the next Public Hearing.

Rick Ewing: If I could ask one question?  Did I understand that you are also considering the release of easements on this alley along with vacations?

Richard P. Wolfe II:  The intention of any Right-of-way is not in the legislation.  We are not keeping anything.  Or at least that is the proposal.  If there is nothing further, then we can close the Public hearing then, back to Special Session.

Comment.

Shane Kremser, City Engineer:  This is related to the East Liberty Sanitary Sewer project.  A little more in the payment.  The trench had to get a little larger due to the existing orientation of the Sanitary Sewer and Storm Sewer; there was a gas line; so they had to dig the trench a little wider in order to work with the new trench.  That is the reason for the extra money request because of the additional asphalt and premium backfill required to fill the trench.   It was an unforeseen thing.  

Ruth Detrow:  Just because I am curious; how do work on the sewer when it is running?  It said in the letter from Mr. Paxton; didn’t it say that one of the reasons why you had to do it right away was because the sewer was actually running while you were working.

Shane Kremser:  Yes, it is an active sewer; but they bypass it.  The contractor maintains the sewage, he will do a bypass or they just replace it and do it as quickly as possible.

Mayor Stewart:  You can’t let it run out on the ground. I have never done that or watched that being done.  You have to keep the sewer functional.

Shane Kremser:  Yes, you keep the sewer functional.  It is basically done by pump. You go from one manhole to the other and pump it through a hose.  

Ruth Detrow:  Thank you.  It was just idle curiosity I guess.  It just didn’t seem like it was possible.

William E. Strine:  This Ordinance is necessary due to the fact that we anticipated in Grant from Issue 2 for the Water Treatment Plant for Chlorine Conversion and we did not get that Grant and in anticipating that we got that Grant, there Engineering services completed and so therefore we are changing it from being paid from Fund 450 to Fund 631 which is the water system improvement fund.  We will charge it to the account which is more designed water treatment upgrades; water treatment plant upgrades.  

Robert L. Valentine W1:  So we anticipated the grant; we just didn’t get the grant; is that right?

William E. Strine:  That is correct.

Stephen Stuart: Is it a likelihood that the work will subsequently be performed without the grant money?

Shane Kremser:  Well we are hoping to get the grant this year.   We are going to reapply.  We were actually; the way the funding; we made the list that would be funded, but due to cutbacks we were the last project, thus were not funded.  We are partially funded.  We are just going to resubmit into the project this year.  

Robert M. Valentine W2:  But all the Engineering is already done, right?

Shane Kremser:  Yes.

Richard P. Wolfe II:   Both of the alleys that we have just addressed are included in this one Ordinance which is appropriate to do.  It doesn’t violate the single subject matter when there is more than one street or alley  being considered.  They can be included in one piece of legislation since they are both from the same petitioner.  They were put together in one Ordinance.  They can be separated if Council should desire it.

William E. Strine:  If you look, I think it is on the third page; Rates and the amounts for 2010.  You can see there is Inside millage and Outside millage.  The only Outside millage we have is the Recreation Fund for ½ mill.  The others are all Inside, meaning they are within the ten mill limit and they do not need to be voted on.  We pass this every year.  It is just accepting those rates.  

Ruth Detrow:  It is 3.4 mills Inside millage and the limit is 10 mills.  I thought most, I am thinking of school districts; are clear up to the….

Stephen Stuart:  That kind of sharing I think, went back to the 20’s when that was; when the city, county and the school district share in that millage.  

William Strine:  The ten mills Inside.  The city had some and the school system.

Ruth Detrow:  Okay, so we don’t get 10 mills, we have 3.4 mills and that is all we can have?

William Strine: The city does not get 10 mills.  That is correct.

Stephen Stuart: My guess is that was fixed.  It is not going to change unless one of the other entities give up theirs.

Robert L. Valentine W1:  It might be good that some people know the difference between Inside and Outside.

William Strine:  The Inside millage is millage 10 mills that we don’t get to vote on.  It is assessed automatically.  Anything outside the 10 mill has to be voted on.  Any additional millage for anything now has to be voted on.

Robert L. Valentine W1:  Being Inside or Outside doesn’t affect the amount of money that you collect?

William E. Strine:  No.

Rick Ewing- AU: This particular alley sets entirely within the site of the new Athletic Complex and as such we again own the property on all sides and actually its location puts it underneath the building, which is under construction so we would like to have the alley vacated.

PUBLIC HEARING #3  - Proposed amendment to Chapter 1131 of C.O. creating definition for the term “Bottling Works” as found in C.O. Section 1163.02(c).

Richard P. Wolfe II:  This is creating a definition of Bottling Works.  Bottling Works is one of the permitted uses but it is a very old term and it does relate directly to the Barbasol construction and they have indicated they feel more comfortable if we define what Bottling Works meant, at least to such an extent that it included what their proposed activity is.  As part of our purchase agreement with them, we have agreed Council would do this.  We had to have a Hearing and this is the first opportunity we had to act on this.

Wolfe II:  I point out ordinarily when there is a term in Zoning that isn’t clear as to all the things that it may include, a test is used; it is called the like or similar to test.  Is it like or similar to other uses that are clearly permitted.  Much of our zoning code is 40-50 years old.  The terms as they were when originally adopted may not be used precise or as clear today.  So it is not inappropriate to be more specific in this instance.  I think there are probably a lot of areas where we could do that but that would require a complete overhaul and I don’t think we are prepared to do that at this time.
